TOW BOAT RESCUE Recreational Terms and Conditions 

Thank you for choosing TOW BOAT RESCUE! These terms and conditions (the “Terms”) govern your Membership with TOW BOAT RESCUE. (“TOW BOAT RESCUE.”, “we,” “our,” “us”). Purchase or use of any TOW BOAT RESCUE. Membership subjects the Member or user to the provisions of the Terms, as amended from time to time. This is not an insurance contract.

TOW BOAT RESCUE Recreational membership: We offer one towing service level. Membership eligibility, dues, fees, terms, services and benefits are subject to change without notice. In the event of any changes, the Terms will be updated and published on this page.

  • Definitions – When used throughout, the following words and phrases are defined as follows:
  • Covered vessel is a recreational vessel owned by the Member that becomes disabled on the water.
  • Incident is an event, or a series of events, arising from the same occurrence that rendered the covered vessel disabled.
  • Member is the person or persons identified on the Membership Record and for whom towing benefits apply in accordance with the TOW BOAT RESCUE Recreational membership. 
  • Towing benefits are defined in Section B.
  • Service Area is the geographic area is limited to southern Ontario, Canada. Licensed Towing Company (“TOW BOAT RESCUE service provider. At a minimum, service area includes the navigable waters within 2 hours continuous of the responding TOW BOAT RESCUE. service provider’s port. Service areas vary depending on location and are subject to change. Service areas are found online at ???
  • Non-Restricted location is defined as a dock, mooring or anchorage where the covered vessel is regularly kept, or a dock, mooring or anchorage where the covered vessel can remain 12 or more hours.
  • Towing benefits are provided as follows:
  • Towing assistance to the nearest port or dock or place of repair within 2 hours. Any additional towing will be charged at a member’s discounted rate. Please refer to New web site address for membership rates. Payment will be due upon delivery. As an alternative to towing, the Member may receive a jump start or delivery of fuel, engine fluids, or basic engine parts to avoid a tow. All parts and fuel will be at an extra charge 
  • Soft ungrounding assistance for a covered vessel. Soft ungrounding is considered a vessel that can be  removed within 30 minutes. Anything after 30 minutes are considered a salvage which is an extra charge. Payment is due on delivery. 
  • A tow for the purpose of repairs of a covered vessel from a Non-Restricted location to a dock, mooring, repair facility or point of haul out within 2 hours tow period.
  • Exclusions to towing benefits:
      1. When the vessel is disabled as a consequence of a pre-existing condition, including where the boat is disabled at the time of vessel purchase or membership purchase or when a disabled vessel departs a dock, mooring or anchorage.
      2. Tows from a non-restricted location within the first 15 days after membership purchase.
      3. Salvage, including hard groundings, assistance requiring more than one vessel, pumps, divers, airbags or other special equipment, or vessels abandoned, wrecked, beached, on fire, damaged by fire, taking on water, sinking, sunk, previously sunk, in the surf or surf line, or in any other state of peril.
      4. The cost of fuel, parts or supplies for the covered vessel.
      5. Escort, navigation assistance, search for lost vessels or anchor retrieval.
      6. Un-groundings at any dock or mooring.
      7. Marina charges or customs fees.
      8. When the Member is a guest or paid captain of a vessel, or where the vessel is used for commercial purposes.
      9. Any service not specifically stated in this Agreement as towing benefits.

Additional terms 

  • Term; Activation: Membership is effective following receipt of payment. Seasonal memberships run form May 1-October 31st of each year

  • Your Membership is not insurance: This Agreement is not an insurance policy and does not provide for any compensation, liability or damages arising out of damage or injury to persons, boats or property.
  • In an emergency situation, contact the Coast Guard or other government agency immediately: This Agreement is not a promise of rescue and is restricted to towing benefits which can be provided with equipment immediately available to the towing company. Services will be provided within the safe parameters of the towing company capabilities and will not be rendered when the vessel cannot be safely or reasonably reached or secured or properly serviced without damage or danger to persons or property.
  • Services are provided on an “as available” basis: Services are subject to availability. Alternatives to towing may be provided in the sole discretion of the responding service provider.
  • Terms are subject to change: Membership benefits and services, including service areas and membership service levels, are subject to change without notice. In the event of any changes, the Terms and Member Benefits will be updated and published at  New web site address. It’s the members responsibility to periodically review and understand our terms.
  • Your Right to Cancel: You may cancel this Agreement within 15 days of activation for a full refund of Member dues; a refund of Member dues is contingent on whether towing benefits were provided within the first 15 days if so there is no refund.
  • Our Right to Cancel: We reserve the right to immediately cancel this Agreement for abuse of privileges. This includes, without limitation, misrepresentation of vessel condition, excessive towing, lack of care and diligence in the operation and maintenance of the vessel, and fraud.
  • No Assignment: This Agreement may not be transferred or assigned to another party.
  • Consent to receive text messaging for dispatch purposes: By using our service, you agree to accept text messaging for dispatch purposes.

TOW BOAT RESCUE TRAILERING TOWING SERVICE AGREEMENT

TOW BOAT RESCUE Trailering Agreement, for boat trailering breakdowns, provides a range of benefits to an enrolled MEMBER in good standing, 24 hours a day, seven days a week. Trailer Assist includes for service on the road or towing the trailer to the nearest repair facility or safe location within 50KM of incident.

PAID SERVICES include payment for:

  • 24‐Hour Dispatch Assistance –  in southern Ontario only 
  • Towing – Trailer Assist includes for service on the road or towing the trailer to the nearest repair facility or safe location within 50KM of incident.
  • Flat Tire Assistance – Member’s spare tire (mounted on a wheel) will be placed on the hub, or air will be added if the flat tire is not punctured while Trailering the boat. As an added benefit, after first thirty days of enrollment, flat tire assistance will be provided for a Member’s boat trailer when disabled at its normally kept “home” location. Note; Spare tire can be provided at extra cost. 
  • Battery Boost – A service vehicle will provide a jump start if Member’s towing vehicle will not start, leaving the towing vehicle and boat trailer stranded away from home.
  • Fuel Delivery – A fuel supply will be delivered where possible, if Member’s towing vehicle runs out of fuel while trailering Member’s boat. Member is responsible for the cost of the fuel.

RESTRICTIONS AND EXCLUSIONS TO PAID SERVICES. Paid Services apply to Member’s boat trailer or towing vehicle when either suffers a breakdown while trailering the boat in Southern Ontario. “Trailering the boat” is defined as towing the boat’s trailer to and from the boat as well as using the trailer to move the boat. Member’s “boat trailer” is defined as a boat trailer legally owned, registered, licensed and operated by Member for personal boating recreation. This Towing Service Agreement does not include: cases involving pre‐existing conditions; vehicles, boats or boat trailers which are rented, borrowed or engaged in commercial activity; activities other than Trailering Member’s boat.

In an emergency situation, Member must contact a government agency. This Towing Service Agreement is not a promise of rescue and is not an insurance policy and provides no indemnification for liability or damages arising out of injury to persons, vehicles, trailers, boats

or property. Service Providers utilized by TOW BOAT RESCUE Trailering Agreement. are independent contractors and are not employees of TOW BOAT RESCUE. or its affiliates. Liability for loss, damage or unsatisfactory workmanship remains with Service Provider.

TOW BOAT RESCUE. will dispatch a Service Provider to complete the above listed Paid Services where available. If dispatch is not successful or the breakdown occurs in Southern Ontario, Members will have the option of having the boat trailer and/or towing vehicle towed to the nearest repair facility or safe location within 50 KM of the original breakdown and receive reimbursement for Paid Services up to CDN  $150.

 This Towing Service Agreement does not provide payment for: repairs; diagnosis; battery charging; the delivery or cost of parts to the disabled vehicle or boat trailer; more than one service vehicle; service at a repair facility; towing of the trailer from, or vehicle related breakdowns at, a Member’s home, a storage facility or a repair facility; cases where insurance or other prepaid towing services are paying for the same incident; wreck removal due to highway accidents or other cause. Paid Services listed in this agreement may be restricted due to height & width restrictions of the vehicle, boat and or trailer and may vary based on the Province of Ontario Transportation regulations.

This Towing Service Agreement is not intended to replace proper use and maintenance of Member’s boat, boat trailer and towing vehicle. TOW BOAT RESCUE. may, at its sole discretion, withdraw this Towing Service Agreement for abuses including excessive use. This Towing Service Agreement becomes effective 48 hours on the date of purchase received by TOW BOAT RESCUE and expires concurrent with TOW BOAT RESCUE. Recreational membership that is seasonal from May 1-October 31st yearly.
